TERMS OF SERVICE
By purchasing ticket for a Zomba City Festival you agree to these terms, which form a binding legal contract between ZAP and the festival attendee (“you”). If you are purchasing or receiving a ticket on behalf of another individual, it is your responsibility to ensure that the person attending is aware of these terms and accepts them.
1. Admittance
Your ticket entitles you to admittance to the Festival for which you have purchased. Any and all other costs associated with your attendance (including without limitation travel, accommodation, food & drinks expenses) shall be borne solely by you and ZAP shall have no liability for such costs.
2. Use of Likeness
By attending the Festival you acknowledge and agree to grant ZAP the right at the Festival to photograph or capture your likeness and/or the likeness of your minor children for use on social media and print advertisement without any further approval from you or any payment to you. This grant to ZAP includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.
3. Festival Content
You acknowledge and agree that ZAP, in its sole discretion, reserves the right to change any and all aspects of the Festival.
4. Fake or copied tickets
ZAP is not responsible for any loss or theft of tickets. The ticket holder shall be held responsible if a copy is made of their ticket. Even if an ticket is likely to be counterfeit, ZAP is entitled to refuse to admit the holder of this ticket to the event. People trying to get in or selling fake tickets or wristbands, will be handed over to the police.
5. Solicitation
You shall not solicit business from other attendees and exhibitors. Attendees observed soliciting will be ejected from the Festival and may be banned from future Festivals in ZAP sole discretion.
6. Refunds
Tickets are non-refundable.
7. Liability
Hold Harmless, and Indemnification. You agree that neither the Festival facility nor the ZAP shall be liable for any claims, losses, damages, medical emergencies, sickness, death, injuries or liability which may be sustained by any person while traveling to or attending The ZAP Festivals (including but not limited to) any employee, or any other person or entity. You agree that you will hold harmless and indemnify the ZAP from any and all claims, including losses, damages, death, injuries, or liability (including without limitation, reasonable attorney’s fees and costs) whether to property, person, or otherwise, that arise while participating in the Festival.
8. Code of Conduct
Zomba City Festival is a family friendly experience. We seek to ensure that all guests enjoy the experience in safe and comfortable surroundings without the fear of verbal or physical abuse, either personally or as a witness. We will not tolerate: foul language, excessive intoxication (alcohol and/or recreational drugs), any form of abuse (physical or verbal), threatening behaviour, damage to property, fraudulent misrepresentation, any form of discrimination, failure to follow COVID Safe rules. Behaviour that negatively impacts other people’s experience will not be tolerated, including but not limited to homophobia, biphobia, transphobia, sexism, racism, sexual harassment, threats of or actual violence, abusive language, bullying, stalking, manipulation, wilful exclusion and/or theft. The Festival reserves the right to exclude you from this event and any future events if we believe you are causing the safety of yourself or others to be compromised.
9. Warranties
ZAP gives no warranties on any aspect of the Festival or any materials related thereto or offered at the Festival and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Festival is provided on an “as-is” basis. Neither ZAP nor its affiliates accept any responsibility or liability for reliance by you or any person on any aspect of the Festival or any information provided at the Festival.
10. Children supervision
For the duration of a Festival all parents/guardians/carers are responsible for the continuous care and supervision of their own children. If they are unable to attend personally, they must delegate their responsibilities to an identified adult and ensure that their children are aware of the identity and name of the person responsible for their care. This includes supervision throughout all Festival venues.
